Anima — Terms of Service

A breathing app by Alterras LLC

The short version

Anima is a wellness app, not a medical device. You own your data, we own the app, and the app is provided as-is. By using Anima, you agree to these terms.

1. About these terms

These Terms of Service ("Terms") are an agreement between you and Alterras LLC, a New York limited liability company ("Alterras", "we", "us", "our"). They govern your use of the Anima mobile application for iPhone and Apple Watch ("Anima" or "the app"). By downloading, installing, or using Anima, you agree to these Terms. If you do not agree, do not use the app.

2. What Anima is

Anima is a haptic-guided breathing app designed to support mindfulness, relaxation, and general wellness. It offers guided breath patterns, ambient visuals, and optional session tracking.

3. Health and safety

Before using Anima, consult a qualified healthcare professional if you have or suspect any of the following:

• Any respiratory condition (asthma, COPD, emphysema, etc.)
• Any cardiovascular condition, high or low blood pressure, or history of stroke
• Pregnancy
• A history of panic attacks, anxiety disorders, or dissociative episodes
• Epilepsy or a history of seizures
• Any condition for which controlled or paced breathing may be contraindicated

Stop using Anima immediately and seek medical attention if you experience dizziness, lightheadedness, shortness of breath, chest discomfort, tingling in the hands or face, or any unusual physical symptoms during or after use.

Do not use Anima while driving, operating machinery, swimming, or engaging in any activity where reduced attention could cause harm.

4. Purchases and in-app content

Anima is free to download. Some features are unlocked through a one-time in-app purchase ("Anima Premium"). The purchase is non-consumable — you pay once and retain access on any Apple device signed in with the same Apple ID.

All purchases are processed by Apple through the App Store. Alterras does not receive, store, or have access to your payment information. For pricing, refunds, or billing issues, contact Apple Support directly at getsupport.apple.com. Apple's refund policy applies to all Anima purchases.

You can restore a previous purchase at any time via the "Restore Purchases" button in the Anima paywall screen.

5. Your data

Anima does not collect, store, or transmit personal data to us or any third party. All session history, preferences, and settings are stored locally on your device. Mindfulness session data may be written to Apple Health with your permission. For full details, see the Anima Privacy Policy.

6. Acceptable use

You agree to use Anima only for personal, non-commercial wellness and mindfulness purposes. You will not:

• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the app
• Copy, modify, redistribute, resell, or sublicense the app or its content
• Remove or alter any copyright, trademark, or proprietary notices
• Use Anima in any way that violates applicable law
• Use Anima as a substitute for professional medical, psychological, or emergency care

7. Intellectual property

Anima, including its code, design, visual elements, breath patterns, sounds, haptics, and all related content, is owned by Alterras LLC and is protected by copyright, trademark, and other intellectual property laws. Your purchase grants you a limited, non-exclusive, non-transferable license to use the app for personal purposes. You do not acquire any ownership rights.

Any session data, notes, or moods you record in Anima belong to you and remain on your device.

8. Disclaimer of warranties

ANIMA IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTERRAS DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We do not warrant that Anima will produce any specific wellness, health, or mindfulness outcome.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTERRAS LLC AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF ANIMA.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF ANIMA IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN U.S. DOLLARS ($10), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Alterras LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of Anima, your violation of these Terms, or your violation of any applicable law.

11. Termination

You may stop using Anima at any time by deleting the app from your devices. We may suspend or terminate your access to Anima if you violate these Terms. Upon termination, sections 5 through 13 survive and remain in effect.

12. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of Anima will be resolved exclusively in the state or federal courts located in New York, and you consent to the personal jurisdiction of those courts.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will revise the "Last updated" date below and, where practical, provide notice within the app. Your continued use of Anima after changes take effect constitutes acceptance of the updated Terms.
